We had an “Am I The Jerk” situation that had to do with a woman being half naked on a shared apartment property and one Facebook comment mentioned that it was actually legal to be topless in Texas if you’re a woman. Well, I didn’t believe it until we did some deep investigating aka Googling.

THE VERDICT MAY SURPRISE YOU:

Believe it or not, in certain parts of Texas, it IS legal for women to go topless in public. *Gasps in Spanish*

Texas doesn’t have a statewide law specifically banning women from going topless. However, things can get tricky because local laws can vary, and some cities have stricter public decency codes than others.

In Austin, for example, women have the right to bare their chest in public, thanks to the city’s progressive ordinances.

Not All Texas Cities Are As Friendly:

Before you start planning your topless stroll through every Texas town, a word of caution: many other areas are still more conservative. Cities like Dallas and Houston have laws that could get you fined or arrested for exposing your chest in public.

As of 2024, Texas is one of 36 states in the U.S. that has "top freedom in effect," which means that women can legally go topless in public in certain areas without facing criminal penalties. 

The other states where women can go topless include places like New York, California, Colorado, and Vermont. Some of these states have made toplessness legal through court rulings, local laws, or a general absence of legal prohibition.
