A video has just surfaced of a Montgomery County Constable causing injuries to himself after kicking a car passing by.

ORIGINALLY CHARGED WITH FELONY

David Wargetz, a 50-year-old male from The Woodlands was originally charged with Failure to Stop and Render Aid causing serious bodily injury, a third-degree felony. Wargetz had allegedly hit the officer while he was directing traffic and fled the scene.

"As Inv. McLaughlin was attempting to stop vehicle traffic for cyclists, Wargetz disregarded traffic direction and struck Inv. McLaughlin with his vehicle, and then fled the scene."

However, thanks to dashcam footage, the original charges against Wargetz have been dropped. The video shows that the officer was responsible for his injuries.

The officer, who was directing traffic, is seen kicking Wargetz's vehicle as he passes by, causing him to injure his leg and fall to the ground.

POSSIBLE FUTURE CHARGES

While the video does show Wargetz never intentionally hurt the officer, it does possibly incriminate him of other things.

Part of a press release from the states that the charges have been dropped however, "There is an anticipation that Mr. Wargetz will be charged with the Class C misdemeanor offense of Obedience Required to Police Officers, School Crossing Guards, and Escort Flaggers under Texas Transportation Code § 542.401. Precinct 2 will review the incident for any other actions that may be necessary."
